These Terms & Conditions (“Terms”) govern your use of our website located at https://thesomaticbusiness.com and any related services, products, memberships, coaching, or programs we offer (collectively, “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.

“You,” “your,” “client,” “member” refers to the individual or entity using our Services.

“Content” includes all materials provided through our website or Services: text, graphics, audio, video, images, digital products, coaching materials, courses, etc.

“Membership” refers to any subscription-based service we offer (e.g. The Somatic Business Hub).

“Programs / Coaching / Courses / Offers” refer to any paid services, digital products, coaching, workshops, group programs etc.

2. Acceptance of Terms

By accessing our website or purchasing/participating in any of our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, and any modifications we may make in the future.

3. Who We Serve / Requirements

Some of our Services are intended for individuals who are 18 or older. If you are under 18, you may only use our Services with the involvement of a parent or guardian.

You also agree to provide accurate, current, and complete information where required (such as contact information, payment details).

4. Purchases, Payments, and Refunds

Prices & Payment

Prices for our Services (courses, coaching, memberships, etc.) are as indicated on the website at the time of purchase.

Payments must be made through the payment methods we specify (e.g. credit card, PayPal, or other third-party processors).

You agree to pay all fees in a timely manner; failure to do so may result in suspension or cancellation of your access.

Fees are Non-Refundable / Refund Policy

We may offer refunds under certain conditions, but this is at our discretion and must comply with applicable law.

If a refund is granted, it may be diluted by any costs incurred or services already rendered.

For recurring memberships/subscriptions: you may cancel at any time; cancellation takes effect as per the subscription’s terms (e.g. end of current billing cycle).

To the fullest extent permitted by law, The Somatic Business, its owners, employees, agents, or affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of, or inability to use, the Services.

Our total liability to you for any damages under these Terms will not exceed the amount you paid to us for the specific Service or the amount you would pay for access if applicable, whichever is less.

You agree to indemnify, defend, and hold harmless The Somatic Business and its affiliates, employees, contractors, agents, officers, and directors from any claim, damage, loss, liability, costs or expenses (including legal fees) arising out of or related to:

10. Subscription / Membership Terms

Memberships are billed periodically (monthly or annually, as specified).

You may cancel your membership at any time, but cancellation policies (when access ends, refund if any) depend on the offer you subscribed to.

We reserve the right to modify subscription fees, with reasonable notice, but such changes will apply only from the next billing cycle (unless otherwise stated).

11. Changes to Services or Content

We may change, suspend, or discontinue any aspect of the Services at any time, including content, features, pricing, or availability.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict of law principles.
Any disputes shall be resolved amicably where possible, or otherwise in the competent courts of New Mexico, USA.

For clients outside the United States, Elevate Your Business Consulting LLC reserves the right to resolve disputes through online arbitration or mediation.

15. Miscellaneous

Entire Agreement. These Terms, together with any other policies or terms we reference (e.g. Privacy Policy), constitute the entire agreement between you and us regarding the Services.

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be struck out and the remaining provisions will remain in effect.

Waiver. Our failure to enforce a provision of these Terms does not constitute a waiver of future enforcement of that or any other provision.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign them without restriction.
